Terms of Service

1. Introduction

Welcome to GatherTip, a Bitcoin tipping application developed by STRI Labs Inc. ("STRI Labs," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the GatherTip beta application ("Gather" or the "Service") during its beta phase. By accessing or using Gather, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Beta and Experimental Nature

Gather is currently in a beta phase. Access may be limited, revocable, and provided solely for testing and feedback purposes. The Service is experimental and may contain bugs, errors, or incomplete features. STRI Labs Inc. makes no representations or warranties regarding its functionality, security, or suitability for any purpose. Use of GatherTip is at your own risk. We may modify, suspend, or terminate the beta at any time without notice or liability.

3. User Eligibility and Responsibilities

You must be at least 18 years old and legally capable of entering into these Terms. You agree to:

• Provide accurate information during registration and use.
• Use Gather only for lawful purposes and in compliance with all applicable laws, including those related to cryptocurrencies.
• Not attempt to circumvent beta access restrictions or share your access with unauthorized users.
• Not upload, post, share, or promote nudity, X-rated content, or illegal content. Not safe for work (NSFW) content is otherwise permitted.
• Report any issues or feedback promptly.

4. Bitcoin Tipping and Financial Limitations

Gather enables peer-to-peer Bitcoin tipping. You are solely responsible for all Bitcoin transactions, including sending, receiving, and any associated fees or taxes. STRI Labs Inc. does not custody, hold, or manage your Bitcoin; all transactions occur on the Bitcoin Spark network. If your balance becomes more than $250 we strongly recommend transfer to a more secure wallet or cold storage.

Important Limitations:

• This beta is experimental. Only use small amounts of Bitcoin (e.g., no more than 100,000 satoshis or $100 per tip or session) to minimize potential loss.
• Do not use Gather for high-value transactions, investments, or as a primary financial tool.
• Bitcoin transactions are irreversible; we cannot recover lost funds. Verify user profiles carefully before tipping.
• STRI Labs Inc. is not a financial institution and provides no financial advice. The value of Bitcoin is volatile, and you may lose value or gain value depending on the spot price of Bitcoin.
• We recommend periodically converting part of your wallet's funds into dollars or stablecoins using an exchange, or another wallet connected to a bank account.

5. Intellectual Property

GatherTip, including its software, design, and content, is owned by STRI Labs Inc. or its licensors. You are granted a limited, non-exclusive, revocable license to use GatherTip for beta only. You may not copy, modify, distribute, or reverse-engineer the Service. Any feedback you provide becomes our property without compensation.

6. Privacy

Your use of GatherTip is subject to our Privacy Policy. We collect limited data for testing and improvement only. We do not resell your data to third parties. Certain interest and tipping characteristics may be used for marketing purposes; however we never disclose any more information than is provided in a user profile. We may disclose information about you if we believe in good faith that disclosure is required by law, regulation, or legal process, including a valid warrant, court order, subpoena, or other compulsory request from a government or law enforcement authority.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. STRI LABS DISCLAIMS LIABILITY FOR ANY LOSS OR DAMAGE FROM USE OF GATHERTIP, INCLUDING BITCOIN LOSSES, DATA BREACHES, OR DOWNTIME.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRI LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF GATHER. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

9. Termination

We may terminate your access at any time for any reason, including violation of these Terms. Upon termination, you must cease using Gather.

10. Governing Law and Disputes

These Terms are governed by the laws of California, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of California, with arbitration in San Francisco.

11. Changes to Terms

We may update these Terms at any time. Continued use of GatherTip after changes constitutes acceptance.
